Teesta Setalvad, activist and human rights campaigner for justice for the victims of anti-Muslim violence gave Henry Volken Memorial lecture at the Social Institute India July 12 on "Dilemmas of a Republic: constitutional principles against majority rule." It also coincided with the celebration of the Golden Jubilee of the Institute in Bangalore. We reproduce excerpts of the address. Editor

There is sixty three years since independence and we need to decide "what to do?" And "what can be done?" And learn to differentiate between the two. Signs of majoritarian were slipping in the political system for a long time and were clear from 1998. Now they seem to have entrenched.
Free use of hate speech in violation of Article 153 A of the Indian Constitution, but it took ten years for the Electoral Commission to prohibit Bal Thackeray to exercise their right to vote in elections. And remember, this has not prevented the government of Maharashtra to give him a funeral State. He also expressed do not have faith in democracy.
Not only that, the state seems to be lying when it comes to taking action against public hate merchants. Narendra Modi had described the relief camps set up after the fight against Muslim violence in Gujarat in 02 as "baby-making factories" and Varun Gandhi nicknamed Muslim vermin. He was acquitted by the court during the 51 witnesses turned hostile statement.
Muslim cause for positive affirmation suffered a setback during the debates of the Constituent Assembly that the Muslim leadership had been put on the defensive after the partition. Muslims should have been included among the socially and educationally backward communities (ESCB). They were assured of their interests being looked after well. But Patel said clearly he did not trust Muslims. It is unfair to exclude Muslims and Christians booking class for SEBCs that their poverty is too obvious to be missed. In addition, the caste is too deeply rooted in the Indian social system and does not disappear with the change of religion.
The communalism policy is the worst tool to dispose of some of the population. Muslims are accused of lack of patriotism while the RSS still has not reconciled with the fact of being the tricolor national flag. He said openly that the national flag should be saffron color.
The order books of the majority mainly day project. In Gujarat, they say that Muslims, Christians and Parsis are foreigners. These manuals do not say it is the children that Babasaheb Ambedkar converted to Buddhism because of the oppression of the caste motivated against Dalits. These books are also missing the story of Savitribai Phule who started the first all-female school in Bhilewada, Pune in the 19th century and was excommunicated from the community. He was Usman Shaikh, a Muslim who has provided shelter. The textbooks do not ask why Mahatma Gandhi, the man of peace was killed. the same story in Pakistan, children are taught to the Mughal period and the preceding period of Hindu dynasties and Aryan civilization is given by a go. If these facts are included, the story would make the fundamentally secular society.
There are seven Indian states that have passed legislation under the name of "freedom of religion" that effectively prohibit the conversion. This militates against the Constitution. But enthusiasm for the promulgation of the law against targeted violence to check communal riots and setting responsibility among officials responsible for the maintenance of law and order is sorely lacking. We had terrible communal violence episodes since 1961 when Jabalpur riots broke the reign of peace. Nellie, Bhagalpur, Meerut, Maliana and Hashimpura, Mumbai and Gujarat, anti-Sikh violence in Delhi and expulsion of Kashmiri Pandits left a trail of blood and gore with sickening frequency. Yet the wheels of justice do not move. No emergency is shown in pushing the Bill to Parliament Targeted violence. The law should introduce a legal redress for victims of the riots. Currently there is no standard repair. Even violence against minority language too should be included in the bill. The Stringent action should be taken against hate speech and hate literature vomiting. leading police as Vibhuti Narain Rao and F. Rodriguez Ribero have suggested that communal violence can not continue for more than 24 hours unless the administration and the government intend to let them continue.
Instead of these measures, we are being requisitioned by majoritariansim. People who defend these causes are accused of communalizing the country. Same argument was used during the agitation against reservation for OBC was conducted.
Politicians have started to raise their political careers on flagrant majoritarianism. Mayaben Kodnani was seen distributing swords and trishuls among the people to attack Muslims. There were 14 eyewitnesses against it. Chief Minister Narendra Modi is not ashamed of it. Instead, he promoted him in the cabinet. Everyone knows that the Congress backed thugs were behind the massacre of Sikhs in Delhi after the assassination of Indira Gandhi in 1984. However, Congress came to power. Rajiv Gandhi gave a ticket to three main accused Minister H. L. K. Bhagat, Jagdish Tytler and Sajjan Kumar and. We can not just blame the Constitution and politicians. Even voters behave the same way and elect politicians responsible for the spread of community hatred and violence. How much more shameful than you can get by naming Amit Shah as BJP's chief campaigner in Uttar Pradesh.
Democracy is not and can not be reduced to brute majoritarian, gross numbers game. In matters of conscience the majority has no place. The violence in Gujarat should deeply shake the conscience of our nation. The response of those accused of genocide sponsored by the state and their increasing respectability and hold positions of power should seriously question the writ of constitutional governance. It is to know that and to accept without challenge that constitutes the deepest threat to Indian democracy today.
